The Supreme Court has rejected Nirbhaya rape case convict Mukesh’s challenge plea, stating, suffering in prison cannot be the grounds for accepting mercy petition for execution.

Nirbhaya rape case convict Mukesh Singh, who challenged President Ram Nath Kovind’s decision of rejecting his mercy plea, has been dismissed by the Supreme Court. 


The bench of Justices R Banumathi, Ashok Bhushan, and AS Bopanna have delivered the verdict on Wednesday.



The court has made it clear that all documents were present before the President, and he had made his decision only after considering it all.


While, advocate Anjana Prakash, who represented Mukesh Kumar Singh in court allegedly put in defense that his client was tortured physically and mentally in Tihar jail, and was also kept in solitary confinement, the apex court stated that suffering in prison cannot be the grounds for accepting mercy petition for execution.


It was on January 17, when Mukesh’s mercy plea was rejected by the Indian President and his day of execution had been held on February 1st, Saturday at 6 in the morning. 


However, Mukesh submitted his plea challenging President’s decision, which now being dismissed will sustain the court’s verdict for his execution on the mentioned day and time. The other 3 rapists Pawan Kumar Gupta, Vinay Kumar Sharma, and Akshay Kumar Singh convicted in the Nirbhaya rape and murder case are also to be hanged on the same date.



A bench headed by Chief Justice S.A. Bobde and comprising Justices B.R. Gavai and Surya Kant affirmed, “If somebody is going to be hanged, then nothing can be more urgent than this.’


The 2012 horrendous rape and murder of a young medical student in Delhi shook the nation, and it’s been seven years that Nirbhaya’s parents have been fighting for justice for their late daughter, demanding adequate punishment for the convicts.
